1. Purpose
This Privacy Policy explains how SimplB collects, uses, stores, shares and protects personal information when clients, prospective clients, representatives, service providers and website visitors interact with SimplB.
SimplB is South Africa's Bitcoin savings and custody specialist, operating as a Juristic Representative of CAEP Asset Managers (Pty) Ltd (FSP 33933). SimplB processes personal information to provide services, meet regulatory duties, prevent financial crime and manage client relationships.
2. The Data We Manage
- Identity and contact information, including name, identity or passport details, date of birth, email, phone number and address.
- KYC information, including proof of address, source of funds and identity verification results, collected once your account moves into onboarding.
- Financial and transactional information, including bank details, deposit references, transaction history and Bitcoin wallet information.
- Screening information, including sanctions, politically exposed or influential person indicators and adverse media results.
- Technical and website information, including device, log, usage and cookie related information where applicable.
- Communications with SimplB, including support requests, onboarding forms, declarations, complaints and service messages.
3. Why We Process Personal Information
- To onboard, verify and risk-rate clients.
- To provide Bitcoin savings, buying, self-custody vault and related services.
- To comply with the FIC Act, AML and counter-terrorist-financing requirements, FSCA and FAIS obligations, POPIA, PAIA and other applicable law.
- To screen clients and transactions for sanctions, money laundering, fraud, adverse media and other financial crime risks.
- To process EFT deposits, Bitcoin buys, refunds, reconciliations, complaints, support requests and service communications.
- To keep records, respond to regulators, auditors, banks and authorised service providers and protect SimplB's rights and systems.
4. Who We Share It With
SimplB shares personal information only where lawful, necessary and proportionate. Recipients may include:
- CAEP Asset Managers (Pty) Ltd, our regulated brokerage partner and licensed FSP, for account opening, compliance and data management.
- VALR and Luno, our exchange and execution partners, for holding, trading and settling Bitcoin on your behalf.
- Our custody infrastructure provider, for your self-custody vault.
- KYC, screening, compliance and transaction monitoring providers.
- Our banking partner, for processing your EFT deposits.
- Professional advisers, compliance officers, auditors and legal advisers.
- Technology, cloud, email, document storage and support service providers, including the secure client portal at simplb.com.
- Regulators, law enforcement, courts, ombuds, banks or other authorities where required or permitted by law.
We do not sell your information.
5. Cross-Border Processing
Some providers, including our exchange and custody partners, may process information outside South Africa. Where this happens, SimplB takes reasonable steps to ensure appropriate safeguards, contractual protections or lawful transfer grounds are in place.
6. Security
SimplB applies administrative, technical and organisational safeguards appropriate to the nature of the information and the risks involved. These include access control, provider due diligence, secure storage, confidentiality obligations, monitoring and incident response procedures. No system is completely secure. We continue to improve our safeguards as SimplB's services mature.
7. Retention
SimplB retains personal information for as long as necessary for the purpose it was collected, to provide services, to meet legal and regulatory duties, to resolve disputes and to maintain required records. AML and FIC Act records may need to be retained for at least the period required under applicable law, even after an account is closed.
8. Your Rights
Subject to applicable law, you may request access to your personal information, ask us to correct it, ask us to delete it or object to certain processing of it. If you are a client, you can view, download or request deletion of your data any time from your secure SimplB client portal. Anyone can also send a request using the contact details in this policy. SimplB may need to verify your identity before responding. Some records may need to be retained for as long as the law requires.
9. Security Compromises
If SimplB has reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, SimplB will follow its security compromise process, including notification to the Information Regulator and affected data subjects where required.
